Mental and Nervous Injury

Generally, a worker's injury that occurs in the course of his employment is compensable even though it is a mental or nervous injury as opposed to a physical one. With causation and "arising out of the employment" issues dispensed with, the majority of states find that a mental condition, which causes a physical injury, is compensable. For example, a worker is frightened by a sudden event or accident and immediately thereafter suffers a heart attack. Compensability is no less viable when the mental stimulus is sustained over a period of time. For example, an employee who over the course of months is so pressured by the demands of his employer and his position that, even though relatively young, he suffers a heart attack.More...

Compensation for longshore, harbor, and maritime workers

The LHWCA provides medical benefits, compensation for lost wages, and rehabilitative services. Additionally, should an employee suffer a fatal injury, the LHWCA provides for survivor benefits and the payment of reasonable funeral expenses. Eligible survivors include not only spouses and children, but also siblings, parents, grandparents, and grandchildren. However, the existence of a widowed spouse and child would preclude the receipt of benefits by the other beneficiaries. More...

Pre-Employment Injuries

Generally, compensation will be denied for injuries incurred prior to an employee being actually hired. However, courts have tended to reject form over substance and allowed compensation when the employee was hired though he had not finished the full hiring process such as completing the employer's business paperwork like payroll and tax forms. Compensation turns on whether a contract of hire has been entered into between the employer and potential employee -- an express or implied contract will suffice. More...

Pediatric Consultative Examination Reports

A medical professional who has been tapped by the Social Security Administration (SSA) to conduct a consultative examination of a child must include certain information in his report. The SSA mandates that the report containing an assessment of the child's history, examination, and any laboratory findings be consistent with the format for reporting results used for complete internal medicine examinations. The report must be thorough and complete in order to provide the SSA with the necessary information to determine the nature, duration, and severity of the child's impairment as well as the limitations that such impairment places on the child.More...
